Underground Storage Tanks (USTs) in Michigan have been closely
regulated since the 1980’s. With some exceptions (residential and farm tanks
under 1,100 gallons in size and a few others), all USTs must be registered with
the state of Michigan. This includes any tank that is in the ground even if it
has been empty for years. Part 211 of the Natural Resources and Environmental
Protection Act (PA 451) of 1994, as amended, is the statute regulating
these underground tanks. Under this Act, regulated tanks must meet stringent criteria to be legal, and
if the tank is permanently out of use, it must be removed from the ground.
The laws regulating USTs are
